Terms of Service

By downloading, accessing, or using Salty Forecast (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the Service.

Salty Forecast provides hyperlocal weather information — forecasts, tides, wind, radar, marine conditions, water temperature, air quality, and related data — for Florida's Gulf coast and the Keys, with a focus on fishing and time on the water. The Service is provided free of charge. We may add, change, or remove features at any time.

The forecasts, tide predictions, buoy readings, radar, and all other data in Salty Forecast are provided for general informational and planning purposes only. They are not a substitute for official weather warnings, marine forecasts, or navigational information.

Do not rely on the Service for navigation, for decisions affecting safety of life or property, or in any emergency. Weather and water conditions can change rapidly and can differ from any forecast. Before heading out, always consult official sources, including the National Weather Service (weather.gov), NOAA, and the U.S. Coast Guard. You are solely responsible for your own safety and for the decisions you make on the water.

The weather data in Salty Forecast comes from third-party and public sources (including Open-Meteo, NOAA CO-OPS and NDBC, RainViewer, Tomorrow.io, Ambient Weather Network, and Ecowitt). We don't create this underlying data and can't guarantee its accuracy, completeness, timeliness, or availability. Forecasts are inherently uncertain and predictions may be wrong. Third-party services may change, rate-limit, or go offline, which can affect what the app can show.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these terms.
• Attempt to disrupt, overload, scrape at scale, reverse engineer, or gain unauthorized access to the Service or its underlying systems and data providers.
• Resell, redistribute, or commercially exploit the Service or its data in a way that violates the terms of the underlying data providers.
• Misrepresent the Service or remove attributions and credits.

The Salty Forecast name, design, original text, and software are owned by us and our licensors and are protected by applicable law. Underlying weather data and imagery remain the property of their respective providers and are used subject to their terms. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data will be accurate or reliable.

To the fullest extent permitted by law, Salty Forecast, its operator, and Lasbury Tracy Realty will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, property, data, or goodwill, or for any personal injury or death, arising out of or related to your use of — or inability to use — the Service, even if advised of the possibility of such damages. Because the Service is provided free of charge, our total liability for any claim relating to the Service is limited to one hundred U.S. dollars ($100). Some jurisdictions don't allow certain of these limitations, so some may not apply to you.

You agree to indemnify and hold harmless Salty Forecast, its operator, and Lasbury Tracy Realty from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these terms.

The following applies when you use the Salty Forecast iOS app obtained from the Apple App Store:

• These terms are between you and Salty Forecast only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app. Any warranty, to the extent one exists, is our responsibility, not Apple's; if the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation.
• We, not Apple, are responsible for addressing any claims relating to the app, including product-liability, legal/regulatory, and intellectual-property claims.
• You represent that you aren't located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you're not on a U.S. Government prohibited-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

We may modify the Service or these terms at any time. When we make material changes to the terms, we'll update the "Last updated" date above. Continuing to use the Service after changes take effect means you accept the updated terms.

You can stop using the Service at any time. We may suspend or discontinue the Service, or your access to it, at any time — including if you violate these terms. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, and indemnification) will survive.

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, to the extent permitted by law.
